These Terms of Use (including any document incorporated reference herein) apply to all websites, mobile applications, and online interfaces owned and operated by Alleviate Financial Solutions LLC (“AFS”), or its affiliates, including www.alleviate.com, www.alleviatefinancial.com, the Alleviate Financial Solutions mobile app, and its AI-enhanced Client Dashboard (collectively, the “Platform”).

PLEASE READ THESE TERMS OF USE CAREFULLY. BY REGISTERING FOR, ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS OF USE. IF AT ANY TIME YOU DISAGREE WITH ANY OF THESE TERMS AND CONDITIONS, YOU SHOULD IMMEDIATELY CEASE YOUR USE OF THE PLATFORM.

These Terms of Use affect your legal rights, including an agreement to resolve disputes that may arise between us by arbitration on an individual basis instead of by class actions or jury trials.

For the purpose of these Terms of Use:

“Services” means the provision of debt resolution services provided by AFS as well as other financial products or services provided by third party affiliates.

“Platform Content” means all content included in or made available through the Platform or Services, such as text, graphics, logos, images, audio, video, software, data compilations, related features and functionality, and the overall design and arrangement of the Platform.

1. Privacy Policy

Please review our Privacy Policy at www.alleviate.com/legal/privacy/glba carefully to understand how AFS collects, uses and discloses personally identifiable information from the users of its Platform. By accessing or using the Platform, you consent to all actions that we take with respect to your data consistent with our Privacy Policy.

2. Eligibility/User Obligations

By installing, accessing, or using the Platform, you represent that you are at least eighteen (18) years of age and will, at all times, provide true, accurate, current, and complete information when submitting information or materials on the Platform, including, without limitation, when you provide information via a Platform form. Moreover, you agree not to impersonate any other person or entity, whether actual or fictitious, including impersonating an employee or representative of AFS, when using the Platform. If you provide any false, inaccurate, untrue, or incomplete information, AFS reserves the right to terminate your access and use of the Platform. You acknowledge that you are solely liable for any consequences arising from providing false, inaccurate, or incomplete information, including any losses, damages, or claims against AFS.

3. Products and Services

Visitors to the Platform can research and submit requests for different types of Services, and, in some cases, access the Services via the Platform. You understand and agree that if you submit a request for any Services or for further information relating to any Services offered through the Platform, AFS will share your information as may be required in order to match you with selected providers of the products and/or services that you request. By submitting your contact information on the Platform, you are expressly consenting to be contacted by AFS or by one or more providers of Services by telephone, email or postal mail, even if you have opted into the national Do Not Call List administered by the Federal Trade Commission, any state equivalent Do Not Call List, or the Do Not Call List of any specific institution.

4. Modifications to the Platform and Terms of Use

AFS reserves the right to change, modify, add or remove any content, materials or information appearing on or in connection with the Platform, including these Terms of Use or any portion thereof, at any time by posting amended Platform Content or Terms of Use on the Platform. Please check these Terms of Use periodically for changes. Your continued use of the Platform after the posting of changes constitutes your binding acceptance of such changes. Except as otherwise provided herein, such amended Terms of Use will be effective immediately and without further notice.

5. Intellectual Property Rights

All Platform Content is the property of AFS or its content suppliers and protected by United States and international copyright laws.

The AFS name, logo, and all related trademarks, service marks, and trade dress are the exclusive property of AFS and may not be used in connection with any product or service that is not AFS’s, or in any manner likely to cause confusion, or that disparages or discredits AFS. All other trademarks appearing on the Platform are the property of their respective owners.

Nothing in these Terms of Use grants you any right, title, or interest in any Platform Content or AFS intellectual property, except for the limited license set forth in Section 6.

6. License and Access

Subject to your compliance with these Terms of Use and any terms applicable to your use of the Services, and your payment of any applicable fees, AFS or its content providers shall grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Platform solely for the purpose of accessing Platform Content and Services for your personal, non-commercial use.

This license does not permit resale or commercial use of the Platform, Services, or Platform Content; creation of derivative works from the Platform, Services, or Platform Content; or downloading, copying, or use of account, applicant, or consumer information for the benefit of any third party. No Platform Content may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use. Additional restrictions on your use of the Platform, including prohibitions on data mining, automated access, competitive use, and collection of user information, are set forth in Section 15 (Acceptable Use Policy).

You are granted a limited, revocable, non-exclusive right to create a hyperlink to the Platform so long as the link does not portray AFS or the Services in a false, misleading, derogatory, or otherwise offensive manner, or imply sponsorship or endorsement by AFS of your website, page, or content.

Except for the limited rights expressly granted in these Terms of Use, all right, title, and interest in and to the Platform and all Platform Content are reserved by and remain the property of AFS. Unauthorized use of the Platform, Services, or Platform Content immediately terminates any license granted you under these Terms of Use.

AFS reserves the right to deny access to the Platform to anyone, without notice and in its sole discretion, for any reason, including violation of these Terms of Use.

7. Your Account

You may need to create an account to access certain Platform features and Services. During registration, you agree to provide current, complete, and accurate information as requested. You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You accept responsibility for all activities that occur under your account.

You agree to notify AFS immediately of any unauthorized use of your account or any other security breach. You agree to log out of your account at the end of each session. You may not use another person’s account without that account holder’s prior permission.

AFS will not be liable for any loss or damage arising from unauthorized use of your account. You may be held liable for losses incurred by AFS or any third party resulting from unauthorized use of your account due to your failure to maintain the confidentiality of your account credentials.

You must be at least 18 years of age to create an account and use the Platform. AFS reserves the right to refuse service, terminate accounts, remove or edit content, or suspend access to the Platform in its sole discretion.

8. User Submissions or Feedback

From time to time, AFS may invite feedback on the Platform, products, or services. Any ideas, suggestions, feedback, comments, or other submissions you voluntarily provide to AFS (“Feedback”) will be treated as non-confidential and non-proprietary.

By providing Feedback, you grant AFS a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, distribute, and otherwise exploit such Feedback in any medium and for any purpose, without compensation or attribution to you. AFS is under no obligation to respond to or use any Feedback.

This section does not apply to personal information you submit through the Platform or to communications related to your account or your enrolled Services with AFS, which are governed by AFS’s Privacy Policy.

9. Third-Party Content and Links

The Platform may contain content provided by third parties and links to websites or products or services that are independent of AFS. These are included for convenience only and do not constitute approval, endorsement, or warranty by AFS.

AFS is not responsible for the accuracy, completeness, or reliability of any third-party content, nor for the products or services offered through any linked website. Any transactions or arrangements between you and a third party are at your own risk. AFS makes no representations or warranties regarding third-party websites, products, or services, and will have no liability arising from your use of or interaction with any third party, even if accessed through a link on the Platform.

When you follow a link to a third-party website, you leave the AFS Platform. Any personal information you provide on that website is not collected or controlled by AFS and will be subject to that website’s own privacy policy and terms of use. We encourage you to review those policies before submitting any information.

AFS does not make credit decisions in connection with any product or service offered by a third party, and does not recommend, endorse, or guarantee any third-party products or services.

10. Disclaimer of Warranties and Limitation of Liability

Disclaimer of Warranties

THE PLATFORM AND ALL INFORMATION, CONTENT, SERVICES, PROGRAMS, PRODUCTS, AND MATERIALS MADE AVAILABLE THROUGH THE PLATFORM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. AFS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE PLATFORM OR ANY CONTENT, SERVICES, OR MATERIALS MADE AVAILABLE THROUGH IT.

TO THE FULLEST EXTENT PERMITTED BY LAW, AFS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. AFS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. NO INFORMATION OBTAINED FROM AFS THROUGH THE PLATFORM SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING FROM YOUR USE OF THE PLATFORM OR ANY CONTENT DOWNLOADED FROM IT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AFS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF AFS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, AFS’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE LESSER OF THE AMOUNT YOU PAID TO AFS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless AFS and its subsidiaries, affiliates, officers, directors, employees, agents, service providers, and successors from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: your use or misuse of the Platform or Services; your violation of these Terms of Use; your breach of any representation or warranty in these Terms of Use; any User Content you submit; your violation of any third-party rights; and/or your violation of any applicable law or regulation. This obligation extends to violations or misuse conducted by your employees or agents.

AFS reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification under this section. You agree to cooperate with AFS’s defense of any such claim. AFS will use reasonable efforts to notify you of any claim, action, or proceeding upon becoming aware of it.

12. Dispute Resolution and Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE CLAIMS HEARD BY A JURY.

Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact AFS to attempt to resolve the dispute informally. You must send a written notice describing the nature and basis of the claim and the specific relief sought (“Notice of Dispute”) by certified mail or overnight delivery (signature required) to: Alleviate Financial Solutions LLC, Attn: Legal Department, 4 Park Plaza, Suite 1500, Irvine, CA 92614. If AFS does not have a physical address on file for you, Notice may be sent by email. AFS will send any Notice of Dispute to you at the address associated with your account. The parties agree to negotiate in good faith for sixty (60) days from receipt of the Notice of Dispute before initiating arbitration. The notice and negotiation period shall toll any applicable statutes of limitations and filing deadlines.

Binding Arbitration

If a dispute cannot be resolved informally, you and AFS agree that any claim, dispute, or controversy arising out of or relating to these Terms of Use, the Platform, the Services, or any relationship resulting from these Terms of Use (collectively, “Covered Disputes”), including disputes about the validity, scope, or enforceability of this arbitration provision, shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. If AAA is unavailable or unable to administer the arbitration, the parties agree to use JAMS under its applicable consumer rules. The Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs the interpretation and enforcement of this arbitration provision.

The arbitrator shall conduct proceedings by telephone or videoconference unless either party requests and the arbitrator approves in-person appearances. Any in-person hearings shall be held at a location mutually agreed upon by the parties or, absent agreement, determined by the arbitrator. The arbitrator shall apply applicable law and the provisions of these Terms of Use. The arbitrator may award any relief that would be available in court under law or equity. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU AND AFS AGREE THAT ALL COVERED DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. NEITHER PARTY MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION, AND THE ARBITRATOR SHALL HAVE NO AUTHORITY TO CONDUCT PROCEEDINGS ON A CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL BASIS.

If the class action waiver in this section is found to be illegal or unenforceable, the entire arbitration provision shall be unenforceable, and any Covered Dispute shall be resolved in court subject to the jurisdiction and venue provisions in Section 13. If any other provision of this section is found illegal or unenforceable, the remaining arbitration terms shall continue in full force and effect.

13. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

Except for disputes subject to arbitration under Section 12, any legal action arising out of or relating to these Terms of Use or the Platform shall be brought exclusively in the federal or state courts located in Orange County, California. You consent to the personal jurisdiction of such courts and waive any objection to venue in those courts.

14. Term and Termination

These Terms of Use take effect when you first access or use the Platform and remain in effect until terminated.

You may terminate these Terms of Use at any time by ceasing all use of the Platform. AFS may suspend or terminate your access to the Platform, in whole or in part, at any time and for any reason, with or without notice. These Terms of Use will terminate automatically if you fail to comply with any provision.

Upon termination, you must destroy all copies of any Platform Content in your possession. AFS may delete or retain your User Content and account information as required by applicable law and AFS’s data retention policies. AFS has no obligation to maintain or provide you with copies of any User Content after termination.

The following sections survive termination of these Terms: Intellectual Property Rights (Section 5), Disclaimer of Warranties and Limitation of Liability (Section 10), Indemnification (Section 11), Dispute Resolution and Arbitration (Section 12), Governing Law and Jurisdiction (Section 13), and this Section 14.

15. Acceptable Use Policy

General Obligations

As a condition of using the Platform, you agree to comply with all applicable federal, state, local, and international laws and regulations. You are solely responsible for all content, communications, and activities conducted through your use of the Platform. Your right to access and use the Platform is conditioned on your compliance with this Acceptable Use Policy.

Prohibited Conduct

You agree that you will not, and will not permit any third party to:

(a) Illegal Activity

  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
  • Engage in, promote, or facilitate illegal activities, including but not limited to fraud, money laundering, terrorist financing, or criminal activity
  • Violate the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Gramm-Leach-Bliley Act, or any other consumer protection, privacy, or financial services law

(b) Interference and Security Violations

  • Interfere with, disrupt, or attempt to gain unauthorized access to the Platform, servers, networks, or systems connected to the Platform
  • Use any robot, spider, scraper, deep link, or other automated data collection or extraction tool, program, algorithm, or methodology to access, acquire, copy, or monitor the Platform
  • Introduce, upload, or transmit any viruses, worms, malware, ransomware, Trojan horses, time bombs, spyware, or other malicious code or harmful components
  • Attempt to probe, scan, or test the vulnerability of the Platform or breach any security or authentication measures
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform
  • Overload, flood, spam, or overwhelm the Platform infrastructure or circumvent any measures we use to prevent or restrict access

(c) Abuse of Service

  • Create multiple accounts or use another person’s account without authorization
  • Use the Platform in any manner that could disable, damage, impair, or interfere with any other party’s use and enjoyment of the Platform
  • Frame, mirror, or otherwise incorporate any portion of the Platform into any other website or service without our prior written consent
  • Use the Platform for benchmarking or competitive analysis, or to build a competitive product or service

(d) Misrepresentation and Fraud

  • Impersonate any person or entity, or falsely state or misrepresent your identity, affiliation, or relationship with any person or entity
  • Provide false, inaccurate, misleading, or incomplete information when registering for or using the Platform
  • Engage in any deceptive, fraudulent, or manipulative conduct

(e) Harmful or Inappropriate Content

  • Upload, post, transmit, or otherwise make available any content that is:
    • Unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, or tortious
    • Obscene, vulgar, pornographic, or sexually explicit
    • Invasive of another’s privacy or publicity rights
    • Discriminatory, hateful, or that promotes hatred, violence, or discrimination based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any other protected characteristic
    • Contains personal or identifying information about another person without that person’s explicit consent

(f) Intellectual Property Violations

  • Upload, post, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right
  • Reproduce, duplicate, copy, sell, resell, distribute, or exploit for any commercial purpose any portion of the Platform without our express written permission

(g) Spam and Unsolicited Communications

  • Send, transmit, or facilitate the transmission of spam, junk mail, chain letters, phishing attempts, surveys, contests, pyramid schemes, or any other unsolicited or unauthorized advertising, promotional materials, or solicitations
  • Harvest, collect, or store personal information or contact information about other users without their express consent

(h) Harassment and Abuse

  • Stalk, threaten, harass, intimidate, bully, or abuse any person
  • Engage in any conduct that restricts or inhibits any person’s use or enjoyment of the Platform

(i) Unauthorized Commercial Use

  • Advertise, promote, offer to sell or buy, or conduct any commercial transactions through the Platform unless expressly permitted in writing by AFS
  • Use the Platform for any business purpose competitive with AFS’s business

(j) Data Mining and Scraping

  • Use any automated means, including bots, crawlers, or scrapers, to access, monitor, or copy any content or information from the Platform
  • Aggregate, repurpose, or redistribute content from the Platform
  • Train artificial intelligence or machine learning models using data or content from the Platform

User Content Responsibility

You are solely responsible for all data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links that you submit, post, or display on or through the Platform (“User Content”). You represent and warrant that: (a) you own or have the necessary rights, licenses, consents, and permissions to use and authorize AFS to use your User Content as described in these Terms of Use; (b) your User Content does not and will not violate any third-party rights or any applicable laws, (c) your User Content does not contain any confidential or proprietary information of any third party.

Monitoring and Enforcement

AFS has the right, but not the obligation, to monitor, review, screen, edit, or remove any User Content or activity on the Platform at any time and for any reason, without notice. AFS may investigate any suspected violation of this Acceptable Use Policy and take any action it deems appropriate in response, including warning users, suspending or terminating accounts, removing content, or reporting activities to law enforcement.

You acknowledge and agree that AFS has no obligation to monitor the Platform or User Content, and AFS shall not be liable for any User Content or for any failure to monitor, review, edit, or remove User Content.

AFS reserves the right to preserve, access, and disclose any information as reasonably necessary to:

  • Comply with applicable law, court orders, subpoenas, or governmental requests
  • Enforce these Terms of Use
  • Respond to claims that User Content violates the rights of third parties
  • Cooperate with law enforcement in investigating claims of illegal or improper activity
  • Protect the rights, property, or safety of AFS, its users, or the public

Cooperation with Law Enforcement

AFS reserves the right to disclose any information, including User Content and account information, to law enforcement, government officials, or third parties as AFS, in its sole discretion, believe necessary or appropriate to:

  • Comply with applicable law, regulation, legal process, or governmental request
  • Enforce these Terms of Use
  • Investigate, prevent, or take action regarding suspected or actual illegal activities, fraud, or violations of these Terms
  • Protect the rights, property, or safety of AFS, our users, or the public
  • Respond to claims that User Content violates the rights of third parties

You agree to cooperate with AFS in any investigation and to provide any information reasonably requested by AFS related to your use of the Platform.

Termination for Violation

AFS reserves the right, in its sole discretion, to:

  • Suspend or terminate your access to all or any part of the Platform immediately, without notice, for any violation of this Acceptable Use Policy or any other provision of these Terms of Use
  • Remove or disable any User Content that violates this Acceptable Use Policy
  • Take any other action we deem necessary or appropriate, including seeking legal remedies

Termination of your access will not limit any other rights or remedies available to AFS at law or in equity. Any suspension or termination will not affect your obligations under these Terms of Use that by their nature should survive, including indemnification, disclaimers, and limitations of liability.

Severability

If any provision of this Acceptable Use Policy is found to be unlawful, void, or unenforceable, that provision will be severed from this policy and will not affect the validity and enforceability of any remaining provisions. Each prohibition in this Section 15 is independent and severable from the others.

Changes to Acceptable Use Policy

AFS reserves the right to modify this Acceptable Use Policy at any time. We will provide notice of material changes by posting the updated policy on the Platform with a new “Last Updated” date. Your continued use of the Platform after any changes constitutes acceptance of the revised Acceptable Use Policy.

16. SMS and Automated Communications

This section governs our use of telephone calls, text/SMS messages, and automated communications. By providing your phone number and using the Platform, you consent to these practices.

Consent to Receive Communications

By providing your contact information, you expressly consent to receive communications from AFS via:

  • Telephone calls (including pre-recorded or artificial voice messages)
  • Text/SMS messages (including automated messages)
  • Emails
  • Mobile app push notifications

These communications may be made using an automatic telephone dialing system (ATDS), artificial or pre-recorded voice, or SMS/MMS (multimedia) messages.

Your Phone Number and Contact Information

By providing your phone number when: (i) entering information on our website or mobile app; (ii) filling out enrollment forms or applications; (iii) contacting us for information; or (iv) texting keywords to our number, you authorize AFS to contact you at that number using the methods described above.

Types of Messages You May Receive

Marketing Messages (Requires Express Written Consent):

  • Promotional offers for debt relief services or financial products
  • Information about services you may be interested in
  • Advertisements and marketing communications

Transactional/Service Messages (No Additional Consent Required):

  • Account alerts and payment reminders
  • Settlement offer notifications
  • Program status updates
  • Security alerts
  • Payment confirmations
  • Responses to your inquiries

Consent to marketing messages is separate from and not required to receive transactional service messages.

Important Terms and Conditions

  • Your consent to receive calls or texts is NOT a condition of purchasing any goods or services from AFS. You can enroll in our debt relief program without consenting to marketing calls or texts.
  • Standard text messaging and data rates from your mobile carrier may apply. AFS is not responsible for these charges.
  • Message frequency varies depending on your account activity and program status. You may receive multiple messages per week.
  • Text messages will only be sent between 8:00 AM and 9:00 PM in your local time zone, except for urgent account alerts.
  • The Service is available on most major US carriers. Check with your carrier for compatibility.

How to Opt Out

You may opt out of SMS/text messages at any time through any reasonable means:

Message Delivery and Device Requirements

  • Mobile Device Required: You must have a mobile device capable of receiving text messages and an active account with a participating carrier.
  • Third-Party Infrastructure: Messages are transmitted through your carrier’s network and third-party SMS delivery platforms. AFS is not responsible for delays or failures caused by carrier systems.
  • Device Access: You understand that anyone with access to your mobile device may view messages you receive. AFS is not liable if unauthorized persons view your messages.
  • U.S. Residents Only: This SMS service is available only to residents of the United States.

Consent Documentation and Recordkeeping

AFS maintains records of your consent for regulatory compliance purposes, including:

  • Date and time consent was obtained
  • Method of consent (website form, text keyword, verbal, etc.)
  • Phone number(s) provided
  • Consent language presented to you
  • Your IP address (for online consent)

These records may be used to verify compliance with the Telephone Consumer Protection Act (TCPA) and FCC regulations.

Modifications to SMS Terms

AFS may modify these SMS terms at any time. We will provide notice of material changes through:

17. Recording and Monitoring of Communications

All telephone calls and video calls between you and AFS or our service providers may be recorded or monitored for quality assurance, training, compliance, and legal purposes. We may monitor and retain electronic communications including:

  • SMS/text messages
  • Email correspondence
  • In-app messages and chat
  • Automated system interactions

By calling us, texting us, or using communication features in our Platform, you consent to such recording and monitoring. If you do not consent to recording or monitoring, you may communicate with us through:

  • Call: You may request that we not record by notifying us at the start of any call

Recordings and communications may be:

  • Retained according to our data retention policies

18. Notice

AFS may provide notice to you by email, regular mail, postings on the Platform, or push notification through the mobile app. Notice from AFS is deemed given: twenty-four (24) hours after an email is sent, unless AFS receives notification that the email address is invalid; three (3) calendar days after mailing to the postal address associated with your account; or immediately upon posting to the Platform.

19. Assignment

You may not assign or transfer these Terms of Use or any rights or obligations under them without AFS’s prior written consent. AFS may assign or transfer these Terms, in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

20. Severability

If any provision of these Terms of Use is held to be unlawful, void, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

21. Waiver

AFS’s failure or delay in enforcing any provision of these Terms of Use shall not constitute a waiver of that provision or of AFS’s right to enforce it at a later time. No waiver of any provision shall be effective unless made in writing and signed by AFS.

22. Electronic Form

These Terms of Use and any related documents may be accepted electronically, including by clicking “I agree,” creating an account, or otherwise demonstrating assent through use of the Platform. Electronic acceptance is legally binding and has the same force and effect as a physical signature. You waive any objection to the enforceability of these Terms of Use based on their electronic form.

23. Use of Platform Outside the United States

The Platform is intended for use within the United States. AFS makes no representations that the Platform or its content are appropriate, available, or legally compliant in any other jurisdiction. If you access the Platform from outside the United States, you do so at your own risk and are solely responsible for compliance with all applicable local laws and regulations.

24. Entire Agreement

These Terms of Use, together with the Privacy Policy and any supplemental terms or notices posted on the Platform or presented to you in connection with specific Services, constitute the entire agreement between you and AFS regarding your use of the Platform. In the event of a conflict between these Terms of Use and any supplemental terms applicable to a specific Service, the supplemental terms shall control with respect to that Service.
